ARBITRATION NOTICE: YOU ARE BOUND BY THE ARBITRATION PROVISION SET FORTH IN THE SNAP INC. TERMS OF SERVICE. EXCEPT FOR CERTAIN TYPES OF DISPUTES MENTIONED IN THAT ARBITRATION CLAUSE, YOU AND SNAP INC. AGREE THAT DISPUTES BETWEEN US WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION AS SET FORTH IN THE SNAP INC. TERMS OF SERVICE, AND YOU AND SNAP INC. WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

1. Introduction

Please read these Snap Inc. Snapchat+ Subscription Terms (“Snapchat+ Subscription Terms”) carefully. These Snapchat+ Subscription Terms form a legally binding contract between you and Snap Inc. (“Snap”) and govern your purchase and use of your subscription to Snapchat+ (“Snapchat+ Subscription”). If you live in the United States, these Snapchat+ Subscription Terms govern. If you live outside the United States, then the Snap Group Limited Snapchat+ Subscription Terms apply. These Snapchat+ Subscription Terms incorporate by reference the Snap Inc. Terms of Service, Privacy Policy, Community Guidelines and any other applicable terms, guidelines and policies. To the extent these Snapchat+ Subscription Terms conflict with any of the other terms, these Snapchat+ Subscription Terms will govern. Snapchat+ is part of Snap’s “Services” as defined in the Snap Inc. Terms of Service.

2. Snapchat+ subscription basics

a. Snapchat+ is a paid subscription that provides access to certain features, functionality or other benefits to further enhance your experience on Snapchat (“Snapchat+ Features”). The current list of Snapchat+ Features are set out on our Snapchat+ support page although these are subject to change in accordance with these Snapchat+ Subscription Terms. Your Snapchat+ Subscription is non-transferable to any other account or user of the Services under any circumstances and you may not allow others to use your account to access Snapchat+.

b. You agree, that if you purchase a Snapchat+ Subscription, your subscription will automatically renew on either a monthly or annual basis at the then-current rates, and the payment method used to purchase your subscription will automatically be charged at the start of each new subscription term (“Subscription Term”) until your subscription is cancelled or terminated in accordance with these Snapchat+ Subscription Terms. To avoid future subscription charges, you must cancel your Snapchat+ Subscription at any time before the date on which your subscription renews. Whether your Snapchat+ Subscription renews monthly or annually will be determined on the basis of the initial Snapchat+ Subscription billing plan you select at the point of purchase. By purchasing a Snapchat+ Subscription, you expressly agree that you are authorizing recurring payments throughout the Subscription Term using the payment method you originally used for initial purchase of your Snapchat+ Subscription. If your payment method is declined when a renewal payment is requested, your Snapchat+ Subscription will be cancelled at the end of its term as further set out below. Following cancellation or expiry of the Subscription Term, Snap will remove Snapchat+ from your account and your access and use of any Snapchat+ Features made available to you as part of your Snapchat+ Subscription will immediately cease (including any content or information made available to you in connection with any such Snapchat+ Features). The only way to regain access to Snapchat+ Features is through repurchasing your Snapchat+ Subscription.

c. Snap may from time to time offer Snapchat+ Subscriptions to you on a promotional basis (for example, without charge or at a discounted rate for a limited period of time) subject to you meeting certain eligibility requirements as determined by Snap (“Subscription Offer”). Where Snap does make a Subscription Offer available to you, then:

any other limitations or conditions associated with a Subscription Offer will be determined by Snap in our sole discretion and made available to you when redeeming the Subscription Offer or in other communications from Snap describing the Subscription Offer;
Snap reserves the right to condition or revoke availability of any such Subscription Offer at any time;
no matter how your Snapchat+ Subscription is received, your use of Snapchat+ is subject to these Snapchat+ Subscription Terms and cannot be redeemed or exchanged for money or any other goods or services; and
following the expiry of the period of any Subscription Offer that you redeem, you will automatically be moved to the paid Snapchat+ Subscription you elected at the point of redeeming the Subscription Offer unless you cancel in accordance with these Snapchat+ Subscription Terms.

YOU MUST THEREFORE REMEMBER TO CANCEL YOUR SNAPCHAT+ SUBSCRIPTION IN ACCORDANCE WITH THESE SNAPCHAT+ SUBSCRIPTION TERMS BEFORE THE EXPIRY OF THE SUBSCRIPTION OFFER; OTHERWISE YOU AUTHORIZE US OR YOUR THIRD PARTY PURCHASE PROVIDER TO CHARGE YOUR CREDIT CARD OR OTHER DESIGNATED BILLING METHOD THE FULL FEES FOR THE FOLLOWING BILLING PERIOD(S) UNTIL YOU CANCEL YOUR SNAPCHAT+ SUBSCRIPTION IN ACCORDANCE WITH THESE SNAPCHAT+ SUBSCRIPTION TERMS.

e. SNAP DOES NOT GUARANTEE THAT SNAPCHAT+ OR ANY PARTICULAR SNAPCHAT+ FEATURE WILL BE AVAILABLE AT ALL TIMES OR ANY GIVEN TIME, THAT IT WILL BE ERROR FREE OR THAT SNAP WILL CONTINUE TO OFFER ACCESS TO SNAPCHAT+ OR ANY PARTICULAR SNAPCHAT+ FEATURE FOR ANY MINIMUM LENGTH OF TIME.

In summary: Snapchat+ subscriptions provide access to additional features, which may change over time. Payments auto-renew, unless you decide to cancel. To subscribe, you need to be 18+ (or your parent/legal guardian must have accepted your purchase). Look out for any promotional terms when you take out your subscription. Promotional offers automatically convert to paid subscriptions at the end of the offer period.

3. Your purchase and payment

a. To purchase a Snapchat+ Subscription, you must be a registered user and logged-in to Snapchat and you must first accept these Snapchat+ Subscription Terms, which will be presented to you at the time of purchase. You are solely responsible for any activity on your account and maintaining the security of, and restricting access to, your Snapchat account and password, and you accept responsibility for all purchases and use of a Snapchat+ Subscription that occur under your Snapchat account. Snap reserves the right to refuse or cancel orders at any time and for any reason.

b. When you submit your order for a Snapchat+ Subscription, we or, if applicable, your purchase provider (which may include an app-store provider or any other third party platform through which you can order and pay for a Snapchat+ subscription) ("purchase provider") will send you an electronic notification confirming the transaction using the contact information on file for you. By submitting an order, you authorize your purchase provider (i) to use information you submit to charge your card or other payment method for the price of the Snapchat+ Subscription you purchased, in addition to any taxes, fees and charges as described in these Snapchat+ Subscription Terms; and (ii) to store and continue billing your payment method (e.g., credit card) to avoid interruption of the Snapchat+ Subscription. In the event the charge does not go through, you may be able to re-submit a new payment method to purchase the Snapchat+ Subscription. If you use a purchase provider and you have any issues with completing your payment, please contact your purchase provider directly.

c. When you submit your purchase, you agree to pay the cost of the Snapchat+ Subscription throughout the Subscription Term, plus applicable taxes (including federal, state or local sales, use, value added or similar taxes or fees payable in connection with your Snapchat+ Subscription purchase), fees and charges. Subscriptions will not be processed until payment has been received in full, and failure to pay for the full purchase price will result in cancellation, termination or suspension of your Snapchat+ Subscription.

d. You agree to pay all fees and charges incurred in connection with your purchase at the rates in effect when the fees and charges were incurred. For example, if you purchase with a payment card issued through a bank based outside the United States, your bank may charge you foreign transaction fees and other similar fees.

e. Your payment card issuer agreement governs your use of your designated card and, where applicable, your purchase provider's terms govern your use of the relevant purchasing tool or method. You must refer to your agreement with that party, and not these Snapchat+ Subscription Terms, to determine the rights and liabilities as between you and them.

In summary: To purchase a subscription, you need a Snapchat account. You are solely responsible for your account and any activity through it. If you pay for your subscription using a purchase provider (such as an app store), their terms will apply to your payments in addition to these and you will need to contact them in the event of any payment issues.

4. Our cancellation and refund policy

a. By submitting an order, you expressly request that upon completion of your purchase of a Snapchat+ Subscription, you will have immediate access to, and use of, Snapchat+ and you consent to the immediate supply of all digital services and content contained in Snapchat+. For this reason, except as required by applicable law, all sales for the initial subscription period you have selected are final and we do not offer any refunds or credits for the initial subscription period of the Snapchat+ Subscriptions under any circumstances.

b. You can cancel your Snapchat+ subscription at any time by doing so in your subscription settings in Snapchat or through the cancellation process offered by your purchase provider. If using a purchase provider, how you cancel may vary depending on the operating system of the device you used to purchase your initial Snapchat+ subscription and any additional terms which apply to your relationship with that purchase provider, so please follow the instructions provided by your purchase provider. Your Snapchat+ subscription will automatically renew unless you cancel in accordance with this section at any point before the expiry of your current billing period. Failure to cancel using the method described in this section at any point before your subscription renewal date shall result in your Snapchat+ subscription automatically renewing. If you cancel your Snapchat+ subscription, you will still have access to Snapchat+ through the end of your subscription term.

c. Payments made for Snapchat+ Subscriptions are (except as set out otherwise in these Snapchat+ Subscription Terms or as required by applicable laws) nonrefundable and we do not provide price protection or refunds in the event of a price drop, discount or other promotional offering being made available by us which would reduce the cost of a Snapchat+ Subscription following the commencement of your Snapchat+ Subscription.

d. Snap reserves the right to immediately suspend, discontinue or terminate your access to Snapchat+ at any time and for any reason, at our sole discretion, without prior notice or liability to you (including for if you breach or violate these Snapchat+ Subscription Terms). Except as required by applicable law, in the event of termination or cancellation no refunds will be provided for any unused portion of your Snapchat+ Subscription and such unused portion will be forfeited upon termination of your Snapchat account, your Snapchat+ Subscription or these Snapchat+ Subscription Terms.

In summary: You can cancel at any time. Following cancellation your subscription will continue until the end of the then-current billing period. We also have rights to suspend or terminate your access where you have done something wrong or if circumstances change significantly.

5. Communications from us

a. We may send you electronic notifications about your Snapchat+ Subscription and these Snapchat+ Subscription Terms including about new features and other changes to Snapchat+ at the email or phone number used to sign up for your Snapchat+ account, through in-app notifications, Team Snapchat notifications or by other electronic means. By purchasing a Snapchat+ Subscription, or by using Snapchat+, you consent to receive from Snap and our affiliates the electronic communications described in these Snapchat+ Subscription Terms.

b. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

In summary: Look out for messages about your subscription and these terms.

6. Snapchat+ restrictions

In addition to the restrictions set forth in the Snap Inc. Terms of Service, you agree that you: (a) have not, and will not, purchase and use Snapchat+ for any purpose other than as permitted under these Snapchat+ Subscription Terms and the Snap Inc. Terms of Service; (b) you are not in restricted countries where Snapchat+ Subscription purchases are not permitted; and (c) will not use any payment card or other form of payment to purchase a Snapchat+ Subscription unless you have all necessary legal authorization to do so.

In summary: There are certain rules we need you to follow when you take out and use a Snapchat+ subscription.

7. Snapchat+ availability and Errors

Snapchat may, at any time, revise or change the specifications, content, descriptions or features of Snapchat+. While we do our best to describe our products as accurately as possible, we do not warrant that descriptions, specifications or pricing are complete, accurate, current or error-free. In the event of any pricing or specification error or if you are unhappy with any revision we make to any descriptions, specifications or pricing, your sole remedy is to cancel your Snapchat+ Subscription. Further, in the event of any pricing or specification error, we have the right to refuse or cancel your order at our sole discretion.

In summary: If you think we have made an error in our prices or how your subscription has been described, or if you aren't happy with any changes, you can cancel your subscription.

8. Changes to these terms and pricing

a. From time to time, we may revise these Snapchat+ Subscription Terms as set out in the Snap Inc. Terms of Service. If at any time you don't agree to any changes to these Snapchat+ Subscription Terms, you may cancel your Snapchat+ subscription and stop using Snapchat+ immediately.

b. Snap may change the Snapchat+ Subscription plans or increase or decrease the fees for purchasing a Snapchat+ Subscription from time to time in our sole discretion. We will provide reasonable advance notice of any change to the fees, with any price changes taking effect from the start of the following subscription period after the date of the price change. If you do not agree with any such price change, you have the right to cancel your Snapchat+ Subscription prior to the price change coming into effect as set out in Section 4.

In summary: We might update these terms over time. If there are material changes, we will tell you in advance in accordance with the Snap Inc. Terms of Service and you can stop using the Services before they come into effect. We might also increase the fees over time, but we will let you know in advance so you can cancel before the change takes effect.

9. Final Terms

a. These Snapchat+ Subscription Terms were written in English and to the extent any translated version of these Snapchat+ Subscription Terms conflicts with the English version, the English version will control.

b. Sections 2-4 and 9-10 of these Snapchat+ Subscription Terms will survive any expiration or termination of these Snapchat+ Subscription Terms.

In summary: Our contract with you on these terms is in English. Some parts will continue to apply after the end of our contract term.

These Snapchat+ Subscription Terms form a legally binding contract between you and Snap Group Limited (“Snap”) and govern your purchase and use of a Snapchat+ subscription on Snapchat (“Snapchat+ Subscription”). If you live outside the United States, these Snap Group Limited Snapchat+ Subscription Terms govern. If you live in the United States, then the Snap Inc. Snapchat+ Subscription Terms apply. These Snapchat+ Subscription Terms incorporate by reference the Snap Group Limited Terms of Service, Privacy Policy, Community Guidelines, and any other applicable terms, guidelines and policies. To the extent these Snapchat+ Subscription Terms conflict with any of the other terms, these Snapchat+ Subscription Terms will govern. The Snapchat+ Subscription is “Services” as defined in the Snap Group Limited Terms of Service.

Additional terms specific to the country in which you live may apply; please see the end of these Snapchat+ Subscription Terms for country-specific terms that may apply. Nothing in these Snapchat+ Subscription Terms will affect your legal rights and remedies provided to you under mandatory consumer law of the country in which you are located.

2. Snapchat+ subscription basics

a. Snapchat+ is a paid subscription that provides access to certain features, functionality or other benefits to further enhance your experience on Snapchat (“Snapchat+ Features”). The current list of Snapchat+ Features are set out on our Snapchat+ support page although these are subject to change in accordance with these Snapchat+ Subscription Terms. Your Snapchat+ subscription is non-transferable to any other account or user of the services under any circumstances and you may not allow others to use your account to access Snapchat+. In order to purchase a Snapchat+ subscription, you must be at least 18 years old or confirm that your parent or legal guardian has accepted your purchase of Snapchat+ subscription.

b. You agree, that if you purchase a Snapchat+ Subscription, your subscription will automatically renew on either a monthly or annual basis at the then-current rates, and the payment method used to purchase your subscription will automatically be charged at the start of each new subscription term (“Subscription Term”) until your subscription is cancelled or terminated in accordance with these Snapchat+ Subscription Terms. Whether your Snapchat+ Subscription renews monthly or annually as well as the price of the Snapchat+ Subscription will be determined on the basis of the initial Snapchat+ Subscription billing plan you select at the point of purchase. By purchasing a Snapchat+ Subscription, you expressly agree that you are authorising recurring payments throughout the Subscription Term by such payment method. If your payment method is declined when a renewal payment is requested, your Snapchat+ Subscription will be cancelled. To avoid future subscription charges, you must cancel your Snapchat+ Subscription before the subscription period renewal date as further set out below. Following cancellation or expiry of the Subscription Term, Snap will remove Snapchat+ from your account and your access and use of any Snapchat+ Features made available to you as part of your Snapchat+ Subscription will immediately cease (including any content or information made available to you in connection with any such Snapchat+ Features). The only way to regain access to Snapchat+ Features is by repurchasing your Snapchat+ Subscription.

Snap reserves the right to condition or revoke availability of any such Subscription Offer at any time;
no matter how your Snapchat+ Subscription is received, your use of Snapchat+ is subject to these Snapchat+ Subscription Terms and cannot be redeemed or exchanged for money or any other goods or services; and

d. Snap may modify, suspend, terminate access to, or discontinue the availability of any and all Snapchat+ Features at any time and for any reason, at our sole discretion. Please note that except to the extent required by the applicable law in your jurisdiction, Snap is not liable to you for any such modifications, suspension or discontinuance to Snapchat+ or any particular feature, functionality or benefit of Snapchat+. Nothing in these Snapchat+ Subscription Terms shall exclude or limit the liability of Snap for any liability which cannot be excluded by the applicable law in your jurisdiction.

e. While we will use reasonable efforts to ensure the availability of Snapchat+, Snap does not guarantee, other than to the extent required by the applicable law in your jurisdiction, that Snapchat+ or any particular Snapchat+ Feature will be available at all times or at any given time, that it will be error free or that Snap will continue to offer access to Snapchat+ or any particular Snapchat+ Feature for any minimum length of time.

3. Your purchase and payment

a. To purchase a Snapchat+ Subscription, you must be a registered and logged-in to Snapchat and you must first accept these Snapchat+ Subscription Terms, which will be presented to you at the time of purchase. e. Your payment card issuer agreement governs your use of your designated card and where applicable, your purchase provider's terms govern your use of the relevant purchasing tool or method. You must refer to your agreement with that party, and not these Snapchat+ Subscription Terms, to determine the rights and liabilities as between you and them.

4. Our cancellation and refund policy

a. you violate these Snapchat+ Subscription Terms or we believe that you are engaged in illegal or fraudulent use of the Services;
Snap is required to do so by any competent court of law, regulatory authority, or law enforcement agency or continued provision of Snapchat+ to you creates possible risk or legal exposure for Snap;
doing so is required for the protection, integrity and/or security of our Services; or
our provision of Snapchat+ (in whole or in part) to you is no longer viable as determined by Snap.

e. Except as required by applicable law in your jurisdiction, no refunds will be provided for any unused portion of your Snapchat+ Subscription upon cancellation or termination of your Snapchat+ Subscription, your Snapchat account or these Snapchat+ Subscription Terms and such unused portion will be forfeited upon such termination.

In summary: You can cancel at any time. Following cancellation your subscription will continue until the end of the then-current billing period. In some countries you have additional cancellation and refund rights within the first 14 days. We also have rights to suspend or terminate your access where you have done something wrong or if circumstances change significantly

a. From time to time, we may revise these Snapchat+ Subscription Terms in accordance with the Snap Group Limited Terms of Service. If at any time you don't agree to any changes to these Snapchat+ Subscription Terms, you may cancel your Snapchat+ Subscription and stop using Snapchat+ immediately.

In summary: We might update these terms over time. If there are material changes, we will tell you in advance in accordance with the Snap Group Limited Terms of Service and you can stop using the Services before they come into effect. We might also increase the fees over time, but we will let you know in advance so you can cancel before the change takes effect.

9. Final terms

b. Sections 2-4 and 9-11 of these Snapchat+ Subscription Terms will survive any expiration or termination of these Snapchat+ Subscription Terms.

In summary: Our contract with you on these terms is in English. Some parts will continue to apply after the end of our contract term.

11. Country-Specific Terms

If you live in any of the countries listed below when you subscribe to a Snapchat+ Subscription, the additional terms listed for that country apply to you. If you live in the European Union or United Kingdom when you purchase your Snapchat+ Subscription, the following European Union and United Kingdom terms apply to you in addition to any terms specific to your country as set out further below.

European Union, Norway and United Kingdom:

For individual consumers (not businesses) in the European Union: for details regarding dispute resolution, please follow this link to the EU Commission's Online Dispute Resolution Platform http://ec.europa.eu/consumers/odr/.

In relation to Section 4 of these Snapchat+ Subscription Terms, if you are a consumer located in the European Union,United Kingdom or Norway when submitting a purchase for a Snapchat+ Subscription, you have a statutory right to change your mind and withdraw from the contract within 14 days from the date of your purchase (the “cancellation period”). By using Snapchat+, you expressly consent to Snap permitting you to use the Snapchat+ Subscription within the cancellation period and acknowledge that once the 14 day period has elapsed, you will lose your statutory right to cancel and your sole cancellation rights will be as set out elsewhere in these Snapchat+ Subscription Terms. If you need to cancel your Snapchat+ Subscription during the cancellation period, you just need to follow the instructions provided in Snapchat or those provided by your purchase provider to cancel within the cancellation period. How you cancel may vary depending on how you purchased your initial Snapchat+ subscription and any additional terms which apply to your relationship with any applicable purchase provider, so please read the instructions provided to you upon purchase carefully. Once we receive your cancellation, you will receive an email confirmation. If you cancel your Snapchat+ Subscription in accordance with this section of the Snapchat+ Subscription Terms during the cancellation period, you'll receive a partial refund of the payment you already made to commence your Snapchat+ Subscription which will be pro-rated based on how many days into your Snapchat+ Subscription you were when you cancelled.

In summary: Subscribers in the UK, Norway and the EU get access to the Service straight after purchase and then have 14 days to change their mind, cancel and get a partial refund.

Australia and New Zealand:

Non-Excludable Guarantees: Nothing in these Snapchat+ Subscription Terms (including Section 4) limits, excludes or modifies any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these terms and conditions would contravene any statute or cause any part of these terms and conditions to be void.

Belgium (in addition to those set out under “European Union and United Kingdom” above):

Nothing in these Snapchat+ Subscription Terms will affect your legal rights and remedies under mandatory Belgian law, in particular the Belgian law provisions on the conformity of goods, digital content, and digital services pursuant to articles 1649bis to 1649nonies and 1701/1 to 1701/19 of the (old) Belgian Civil Code (each as amended or superseded from time to time) and the provisions which apply to consumer contracts pursuant to Titel 2 of Book VI of the Belgian Code of Economic Law.
Where the Snapchat+ Subscription Terms refer to Snap’s right to immediately suspend, discontinue or terminate your access to Snapchat+, without prior notice or liability to you, this will constitute a unilateral termination of our agreement with you without prior intervention of a court or tribunal.

France (in addition to those set out under “European Union and United Kingdom” above):

Pursuant to the Code de la Consommation, you are entitled to consumer mediation to resolve disputes between us. You may choose any of the mediators listed at http://www.economie.gouv.fr/mediation-conso/saisir-mediateur under “Commerce électronique - Vente à distance”. Their contact details are available at the individual mediator websites listed there.

Germany (in addition to those set out under “European Union and United Kingdom” above):

Nothing in these Snapchat+ Subscription Terms will affect your legal rights and remedies provided to you under mandatory German law, in particular the German law provisions on digital products and digital services pursuant to Sections 327 pp. German Civil Code (BGB) and the provisions on general terms and conditions pursuant to Sections 305 pp. German Civil Code (BGB) (each as amended or superseded from time to time).

The Netherlands (in addition to those set out under “European Union and United Kingdom” above):

Nothing in these Snapchat+ Subscription Terms will affect the legal rights and remedies that you have and and/or are available to you under mandatory Dutch law, including, without limitation, provisions regarding digital content and digital services pursuant to articles 7:50aa – 50 ap DCC and general terms and conditions pursuant to articles 6:231-247 DCC.

Saudi Arabia:

In relation to Section 4 of these Snapchat+ Subscription Terms, if you are located in Saudi Arabia when submitting a purchase for a Snapchat+ Subscription, you have a statutory right to cancel your subscription within 7 days from the date of your purchase (the “cancellation period”), provided you have not in any way used, accessed or benefitted from the Snapchat+ Services. Please note that by completing your purchase of a Snapchat+ Subscription your access to Snapchat+ will commence immediately at which point you will lose your right to cancel as set out in this paragraph and your sole cancellation rights will be as set out elsewhere in these Snapchat+ Subscription Terms. If you need to cancel your Snapchat+ Subscription during the cancellation period, you just need to let Snap know that you have decided to cancel in accordance with Section 4 or here.

Sweden (in addition to those set out under “European Union and United Kingdom” above):

Nothing in these Snapchat+ Subscription Terms will affect your legal rights and remedies provided to you under mandatory Swedish law, in particular the Swedish provisions on contracts concerning digital content and digital services pursuant to Chapter 9 in the Swedish Consumer Sales Act (Sw. konsumentköplag 2022:260).

United Kingdom (in addition to those set out under “European Union and United Kingdom” above):

Nothing in these Snapchat+ Subscription Terms will affect your legal rights and remedies provided to you under U.K. consumer law including the Consumer Rights Act 2015.
