ARBITRATION NOTICE: IF YOU LIVE IN THE UNITED STATES, YOU ARE BOUND BY THE ARBITRATION PROVISION SET FORTH IN THE SNAP INC. TERMS OF SERVICE. EXCEPT FOR CERTAIN TYPES OF DISPUTES MENTIONED IN THAT ARBITRATION CLAUSE, YOU AND SNAP INC. AGREE THAT DISPUTES BETWEEN US WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION AS SET FORTH IN THE SNAP INC. TERMS OF SERVICE, AND YOU AND SNAP INC. WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Introduction

These Generative Lens Tools Terms form a legally binding contract between you (or your organization) and Snap and govern your use of any generative AI-powered tools Snap makes available to you in or in connection with Lens Studio (which includes SnapML Kit and any generative AI features or tools within Lens Studio, such as GenAI Suite) that use visual and text prompts provided by you to generate outputs based on those prompts for use with the Services (“Generative Lens Tools”). The products and services described in these Generative Lens Tools Terms are “Services” as defined in the Terms of Service. These Generative Lens Tools Terms are incorporated into the Lens Studio Terms, so please read these carefully. To the extent these Generative Lens Tools Terms conflict with the Lens Studio Terms of any other terms or policies referred to in the Lens Studio Terms, these Generative Lens Tools Terms control.

1.  Generative Lens Tools

a. Prompts that you submit to the Services to generate outputs and those outputs themselves (such as software models and 3D assets) are “Assets” as that term is used in the Lens Studio Terms, including for the purposes of the license you grant to us over your Assets and your obligations and liabilities to us for submitting those Assets to the Services. You may use any Assets generated using the Services solely for the purpose of creating Lenses in Lens Studio and you may not use or combine those Assets on or with any other service, platform, or technology.

b. Generative Lens Tools can create Assets that cannot be predicted in advance and might generate content that you consider offensive or objectionable, and by agreeing to these Generative Lens Tools Terms and using the Services, you acknowledge and assume that risk. You also acknowledge and agree that you are responsible for your use of, and any actions you take in relation to, any Assets generated by you through the Services. In addition to the disclaimers in the Snap Terms of Service and Lens Studio Terms, Snap makes no representations or warranties with respect to the Generative Lens Tools, or any Assets you generate using it, and Snap is not responsible for any use of, or actions in relation to, those Assets.

c. We will make your generated Assets available for use in the Services until either you or we remove them. Your submission of prompts and use of the Services to generate Assets, as well as the Assets themselves, will also be used by us to develop and improve machine learning models for use throughout the Services and for research purposes. You agree that, as a result, the license you grant to us over your Assets under the Lens Studio Terms extends perpetually for the purposes set out in this Section. 

d. You acknowledge and agree that Snap and our affiliates own all rights in the Generative Lens Tools including any creative tools we make available to you to create Assets, such as templates.

In summary: You are solely responsible for the prompts you use to generate assets and outputs (including 3D models and assets) and the content of those outputs themselves. We cannot predict what outputs will be generated in advance and sometimes those outputs you generate may not be as expected. We are not responsible for any outputs you create by using the Generative Lens Tools and you may only use those outputs within Lens Studio. All outputs from your use of the Generative Lens Tools are “Assets” for the purpose of the Lens Studio Terms. Please therefore read the Lens Studio Terms carefully as they contain a license grant from you to Snap regarding your Assets, restrictions on what you may do with the Generative Lens Tools, and other important provisions that you must be aware of and comply with regarding your use of the Generative Lens Tools.

2.  Content Restrictions

All prompts submitted by you and any Assets generated by those prompts must comply with the Generative Lens Tools Submission Guidelines, Lens Studio Submission Guidelines, and Community Guidelines, and must be appropriate for people aged 13+.

3.  Entire Agreement

These Generative Lens Tools Terms set forth the entire understanding and agreement between you and Snap with respect of your use of the Generative Lens Tools and supersede all other agreements between you and Snap regarding the Generative Lens Tools.
