Welcome! We are excited that you are interested in Snap’s Top Performer Payout Program (“Program”). The Program permits eligible users who have accepted these Terms (who we refer to throughout these Terms as “Service Providers” or “Creators”) with the opportunity to receive rewards from Snap in connection with their services of creating and submitting high-performing Lenses on Snapchat within Lens Studio, which we define as “Qualifying Activity” and describe further below.

We’ve drafted these Top Performer Payout Program Terms (the “Terms”) so that you’ll know the rules that govern your submission of Lenses to, and participation in, the Program, if eligible as set forth in these Terms. These Terms form a legally binding contract between you (or your organization) and the applicable Snap entity as detailed in the Creator Payment Terms (“Snap”), so please read them carefully. Only users who accept and comply with these Terms will be eligible to participate in the Program.

The Program, and each product and service described in these Terms, are “Services” as defined in the Snap Terms of Service. These Terms incorporate by reference the Snap Terms of Service, Community Guidelines, Lens Studio Terms, Lens Studio License Agreement, Generative Lens Tools Terms, Snap Creator Payment Terms, Snapchat Brand Guidelines, Snapcode Usage Guidelines, Music On Snapchat Guidelines, and Lens Studio Submission Guidelines, and any other terms, policies, or guidelines governing the Services (each an “Incorporated Term”, and collectively, the “Incorporated Terms”). Please also review our Privacy Policy to learn how we handle information when you use the Services. 

To the extent these Terms conflict with any Incorporated Term governing the Service, these Terms will control solely with respect to the Program. All capitalized terms used but not defined in these Terms have their respective meanings as set forth in the applicable Incorporated Term. Please print a copy of these Terms and keep them for your reference.

Any user, account, or Lens that violates these Terms or any Incorporated Term will not be eligible for monetization. For the avoidance of doubt, you must not use or include any music in your Lenses unless you hold all rights in and to such music (including having originally composed, created, performed, and recorded all the music and lyrics yourself) or have separately obtained all rights and or applicable licenses necessary to distribute, synchronize, copy, display, publicly perform, and otherwise use such music in your Lenses worldwide, including from any applicable record labels, music publishers and other rights holders. Any unauthorized use of music in connection with the Program may result in, among other things, suspension or termination of your ability to participate in the Program.

YOU MAY RECEIVE REWARDS FOR YOUR SERVICES IF YOU, THE LENSES YOU SUBMIT, AND YOUR PAYMENT ACCOUNT SATISFY THE MINIMUM ELIGIBILITY CRITERIA. ONLY A SMALL PERCENTAGE OF CREATORS SUBMITTING LENSES TO THE PROGRAM WILL RECEIVE REWARDS.

All Lenses submitted by you to the Program shall be submitted in accordance with, and subject to, the Lens Studio Terms and Lens Studio License Agreement. Lenses submitted to the Program will be subject to review for compliance with these Terms, in accordance with Snap’s moderation algorithms and review procedures, and Lenses that do not comply may not be eligible for the Program. If you have been engaged by or on behalf of Snap outside of these Terms to create or provide Lenses specifically for Snap, you may not be eligible for Payments for those Lenses you created as part of that engagement. Qualifying Lenses (defined below) will be distributed through Snap’s proprietary content distribution algorithm and procedures. If you meet the Minimum Eligibility requirements, have accepted these Terms, and have submitted Qualifying Lenses, then you may receive rewards from Snap for performing the services described herein (“Qualifying Activity”).

To be considered a “Qualifying Lens,” the Lens that you submit to the Program during the Eligibility Period (defined below) must: (i) have been designated “public” in Lens Studio; and (ii) be a high-performing Lens aggregated across all the Regions, calculated in accordance with our proprietary formula, which may be adjusted by us from time-to-time, and which is based on a number of factors, which may include account performance and user engagement (together the "Eligibility Criteria”). “Eligibility Period” means the 90 calendar days following submission of the Lens. You may enroll a Lens in the Program at any time during the Eligibility Period by opting such Lens into the Program within ‘My Lenses’.

You represent and warrant that: (i) you have reached the age of legal majority in the place of your legal residence (if an individual), and otherwise have the full right, power, and authority to enter into these Terms on your own behalf and on behalf of any entity for which you are acting, or you have obtained parental/legal guardian consent, as required in your country of residence, to agree to these Terms; (ii) you have obtained all necessary third party rights, including rights of publicity and privacy and any other rights with respect to name, likeness, and voice, for the appearance of any individual in your Lens, and all necessary parental or legal guardian(s) consent for the appearance of any individual in your Lens who is under the age of eighteen (18) or any other applicable age of majority; (iii) you have read, understand, and agree to comply with all of these Terms, including but not limited to our Terms of Service, Community Guidelines, Lens Studio Terms, Lens Studio License Agreement, Snapchat Brand Guidelines, Snapcode Usage Guidelines, and Lens Studio Submission Guidelines; (iv) the Lenses you submit to the Program are created solely by you, do not infringe, violate, or misappropriate any third-party rights, including, but not limited to, copyright (including master, synch, and public performance music copyright rights), trademark, publicity, privacy, or any other applicable right, and comply with applicable law; (v) you will make any required payments to any third parties with respect to your Lenses and you will not cause Snap to incur any liability to any third party as the result of distributing your content; and (vi) if you are a legal resident of a country other than the United States, you were physically located outside of the United States when you performed the services of creating and submitting the Lenses to the Program.

As mentioned above, if Snap determines you may be eligible to receive a reward under this Program, Snap and our third-party payment provider will notify you via the Snapchat application or the Contact Information you provided in your user profile, including the email address. Snap may also contact you regarding your Lenses that are not eligible to receive rewards and for other reasons. Please check your Snapchat notifications often, keep your email and phone number up to date, and verify your email.

From time to time, we may revise these Terms. You can determine when these Terms were last revised by referring to the “Effective” date at the top. Any changes to these Terms will become effective on the "Effective" date above and will apply to your use of the Services after that time. You agree to review these Terms, including any updates, regularly to ensure that you are familiar with the most recent version of such terms. By using the Service following the public posting of updated Terms, you will be deemed to have agreed to the updated Terms. If you do not agree to the modifications, you must stop using the Service. If any provision of these Terms is found unenforceable, then that provision will be severed and will not affect the validity and enforceability of any remaining provisions.
