এই Snap রূপান্তরের শর্তাবলী এবং ব্যবসায়িক পরিষেবার শর্তাবলীর জন্য, Snap রূপান্তর ব্যবহার করা সত্তাটি অন্য কোনো জায়গার অন্য কারোর এজেন্ট হিসেবে কাজ করলেও, Snap রূপান্তর ব্যবহার করা সত্তাটির ব্যবসার মুখ্য কেন্দ্র ফ্রান্সে হলে, “Snap” বলতে Snap Group SAS কে বোঝাবে, আর সত্তাটির ব্যবসার মুখ্য কেন্দ্র অস্ট্রেলিয়া বা নিউজিল্যান্ডে হলে, “Snap” বলতে Snap Aus Pty Ltd কে বোঝাবে।

Snap রূপান্তর Snap এবং তার সহযোগীদের, পিক্সেল, জাভাস্ক্রিপ্ট, এসডিকে, এপিআই, বা কুকিজের মতো সরঞ্জামগুলির মাধ্যমে ওয়েবসাইট, অ্যাপস, বা ইন স্টোর (“ইভেন্ট ডেটা”) এর ওপর নেওয়া পদক্ষেপগুলি সহ, ডেটা পেতে সক্ষম করে তোলে। Snap এবং তার সহযোগীরা (a) অন্তর্দৃষ্টিগুলি প্রদান করতে; (b) পরিষেবাগুলি উন্নত এবংপরিপূরক করতে (Snap এর উদ্দীষ্ট এবং বিজ্ঞাপনের কার্যকারিতাগুলি অপ্টিমাইজ করা সহ);সহ এবং (c) গোপনীয়তা নীতিতে যেভাবে অনুমোদন দেওয়া হয়েছে সে অনুযায়ী পরিষেবাগুলি প্রদানকরতে ইভেন্ট ডেটা ব্যবহার করতে পারবে।

ব্যবসায়িক পরিষেবার মাধ্যমে Snap আপনাকে সক্ষম না করলে আপনি Snap রূপান্তর কোনো ব্যক্তি বা সত্তার কাছে উপলভ্য করতে পারবেন না, এবং সেক্ষেত্রে, আপনি স্বীকার করছেন এবং নিশ্চয়তা দিচ্ছেন যে, সেই ব্যক্তি বা সত্তা শর্তাবলী মেনে চলছে কিনা আপনি তা খেয়াল রাখবেন, এবং এই Snap রূপান্তর শর্তাবলী অনুযায়ী সেই ব্যক্তি বা সত্তার ওপর কোনো দায় বর্তালে প্রাথমিকভাবে আপনি তার জন্য দায়বদ্ধ থাকবেন। এই Snap দর্শক মানানসইয়ের শর্তাবলীতে যেরকম উল্লেখ করা আছে বা Snap এর পূর্বসম্মতি নিয়ে, পরিষেবাগুলির মাধ্যমে চলমান আপনার বিজ্ঞাপনী প্রচারভিযানগুলি পরিচালনা করতে শুধুমাত্র অভ্যন্তরীণ ব্যবহারের জন্য Snap রূপান্তরের জন্য Snap আপনার কাছে যে ডেটা উপলভ্য করে তা ব্যবহার করতে পারবেন বা, পরিষেবাগুলির মাধ্যমে চলমান সেই সত্তার বিজ্ঞাপনী প্রচারাভিযানগুলি পরিচালনা করতে আপনি যদি অন্য কোনো সত্তার প্রতিনিধি হিসেবে Snap রূপান্তর ব্যবহার করেন; এবং আপনি সম্মত হচ্ছেন আপনি এগুলি করবেন না: (ক) সেই ডেটা প্রকাশ করা; (খ) পরিষেবার কোনো ব্যবহারকারীর প্রোফাইল তৈরি বা পরিপূরক করতে ওই ডেটা ব্যবহার করা; (গ) যে কোনো উপায়ে পরিষেবাগুলির যে কোনো ব্যবহারকারীকে পুনরায় জড়িত করার জন্য ওই ডেটা ব্যবহার করা; বা (ঘ) কোনো সহযোগী, তৃতীয় পক্ষ, বিজ্ঞাপন নেটওয়ার্ক, বিজ্ঞাপন বিনিময়, বিজ্ঞাপনী ব্রোকার, বা অন্যান্য বিজ্ঞাপন পরিষেবার কাছে ওই ডেটা বিক্রয়, ভাড়া দেওয়া, হস্তান্তর না করা,বা প্রবেশাধিকার না দেওয়া।

In addition to your representations and warranties under the Business Services Terms, you represent and warrant that: (a) you will comply with Applicable Law, applicable self-regulatory standards and guidelines, Apple App Store Review Guidelines, and Google Play policies and guidelines (collectively, “Rules”) in your performance under these Snap Conversion Terms; (b) Event Data will not contain any sensitive information or special category data, as defined in the Rules, including any information that is based on or includes: (i) an alleged or actual commission of a crime; (ii) health information; (iii) information about individuals you have actual knowledge are under the age of 13 (or, if greater than the age of 13, the minimum age at which the Processing of Personal Data of a Data Subject is lawful under Applicable Law); (iv) information about individuals collected from an online service directed to children; or (v) information about users’ financial status, racial or ethnic origin, religious beliefs or preferences, sex life or sexual preferences, or trade union membership; (c) you have secured, and will maintain, all necessary rights, licenses, and consents required to send the Event Data and for the Event Data to be used in accordance with these Snap Conversion Terms, including from all Data Subjects whose data is included in Event Data; (d) you will provide sufficient notice to each Data Subject in compliance with the Rules that the Data Subject’s information collected by you or your agents may be shared with and used by third parties for the purposes specified under these Snap Conversion Terms, including, at a minimum: (i) for websites, a clear and prominent notice on each webpage where you utilize Snap Conversion stating that third parties, including Snap, may use cookies, web beacons, and other technologies to collect or receive information from your websites, apps, and elsewhere on the internet, and may use that information to provide measurement services, ad targeting, and other advertising services; (ii) for apps, a clear and prominent link inside your apps’ settings or your privacy policy, and from within any store or website where your apps are distributed, that explains that third parties, including Snap and its affiliates, may collect or receive information from your apps and other apps, and may use that information to provide measurement services, ad targeting, and other advertising services; and (iii) a clear and prominent notice about how and where users can opt out of the use of Event Data for ad targeting; (e) in jurisdictions that require informed consent for storing and accessing cookies or other information of a Data Subject (including the European Union), you must ensure, in a verifiable manner, that each Data Subject provides you with the necessary consent before you use Snap Conversion in connection with that Data Subject; and (f) you will promptly notify Snap of any actual or threatened complaint relating to Event Data and you will reasonably cooperate with Snap, at your expense, in responding or defending against any such complaint.
