ARBITRATION NOTICE: YOU ARE BOUND BY THE ARBITRATION PROVISION SET FORTH IN THE BUSINESS SERVICES TERMS. IF YOU ARE CONTRACTING WITH SNAP INC., THEN YOU AND SNAP INC. WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

These Snap Fit Analytics Terms (“Terms”) form a legally binding contract between you and Snap, govern the use of the Snap Developer Program for Snap’s apparel and footwear recommendation, personalization, and analytics products (“Fit Analytics”), and are incorporated into the Snap Developer Terms. Some terms used in these Terms are defined in the Snap Developer Terms or Business Services Terms.

a. Fit Analytics enables Snap and its affiliates to receive data, including about the products displayed or sold in your Application, purchase and return data, the fit, size, and style of users of your Application, and actions taken on your Application (“Fit Data”). If Fit Data includes any personal data, the Personal Data Terms, including the Data Sharing Agreement, apply. Snap and its affiliates may use Fit Data to provide the Services, including: (i) to provide insights, including to enable you to provide personalized shopping experiences to users of your Application; (ii) to improve and supplement the Services; and (iii) as permitted under the Privacy Policy.

b. To access Fit Analytics, you will provide Snap and its affiliates with access to your product catalog, subject to the Catalog Terms.   

c. Without limiting your obligations in the Snap Developer Terms and if Snap requires you to do so, you will include Snap branding within the Application in the form as required by Snap or as otherwise agreed to by you and Snap.

d. Snap may, from time to time, test improvements to your use of Fit Analytics that may result in different user experiences within your Application.

e. Subject to the restrictions in the Snap Developer Terms and Business Services Terms, and except as Snap may otherwise approve in writing, you may use Business Services Data that Snap makes available to you in connection with Fit Analytics only for your internal use to manage your business.

These Terms set forth the entire understanding and agreement between you and Snap with respect to Fit Analytics and supersede all other agreements between you and Snap regarding Fit Analytics.
